1. Introduction

Welcome to TrikeOps ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the TrikeOps platform, a tricycle operations management system that connects passengers with tricycle drivers, manages bookings, and facilitates communication between users, drivers, operators, and TODA (Tricycle Operators and Drivers Association) officials.

By accessing or using TrikeOps, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

2. Acceptance of Terms

By registering for an account, creating a profile, or using any feature of TrikeOps, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old to use TrikeOps. If you are under 18, you may only use the service with the supervision and consent of a parent or legal guardian.

3. User Accounts and Registration

3.1 Account Creation

To use TrikeOps, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 User Roles

  • Passengers: Users who book tricycle rides through the platform
  • Drivers: Licensed tricycle drivers who provide transportation services
  • Operators: Tricycle operators who manage fleets and drivers
  • Officials: TODA officials who oversee operations and manage memberships
  • Administrators: System administrators who manage the platform

3.3 Account Security

You are responsible for:

  • Creating a strong password (minimum 8 characters with numbers and special characters)
  • Keeping your login credentials confidential
  • Notifying us immediately of any unauthorized access to your account
  • Ensuring all information in your profile is accurate and up-to-date

4. Services Provided

TrikeOps provides the following services:

  • Booking Services: Platform for passengers to book immediate or scheduled tricycle rides
  • Driver Management: Tools for drivers to manage their availability, bookings, and profiles
  • Lost and Found: System for reporting and claiming lost items
  • Rating and Review System: Platform for users to rate and review drivers
  • Membership Management: Tools for TODA officials to manage driver and operator memberships
  • Document Management: Secure storage and management of driver documents and licenses
  • Announcements: Communication platform for important updates and notices

5. User Conduct and Responsibilities

5.1 Prohibited Activities

You agree not to:

  • Use the platform for any illegal or unauthorized purpose
  • Violate any local, state, or national laws or regulations
  • Impersonate any person or entity or falsely state your affiliation with any person or entity
  • Harass, abuse, threaten, or harm other users
  • Post false, misleading, or fraudulent information
  • Interfere with or disrupt the platform or servers
  • Attempt to gain unauthorized access to any part of the platform
  • Use automated systems to access the platform without permission
  • Share your account credentials with others
  • Engage in any activity that could damage, disable, or impair the platform

5.2 Passenger Responsibilities

  • Provide accurate pickup locations and contact information
  • Be present at the agreed pickup location and time
  • Treat drivers with respect and courtesy
  • Pay agreed fares promptly and fairly
  • Report any issues or concerns through the proper channels

5.3 Driver Responsibilities

  • Maintain valid licenses, permits, and insurance as required by law
  • Provide safe, reliable, and professional transportation services
  • Maintain accurate availability status on the platform
  • Respond promptly to booking requests
  • Arrive on time for scheduled pickups
  • Treat passengers with respect and professionalism
  • Maintain vehicle in safe and clean condition

6. Booking Terms

6.1 Booking Types

  • Immediate Bookings: Bookings for immediate pickup
  • Future Bookings: Scheduled bookings for a specific date and time

6.2 Cancellation Policy

For cancellations, passengers should contact the driver directly. TrikeOps is not responsible for fare disputes or cancellation fees, which should be resolved directly between passengers and drivers.

6.3 No-Show Policy

Repeated no-shows may result in account restrictions or suspension. Both passengers and drivers are expected to honor their commitments.

7. Payments and Fares

TrikeOps facilitates connections between passengers and drivers but does not process payments directly. All fare transactions are conducted directly between passengers and drivers. TrikeOps is not responsible for:

  • Fare disputes between passengers and drivers
  • Payment processing or collection
  • Refunds or chargebacks
  • Disputes regarding fare amounts

Fares should be agreed upon before the trip begins, and payment should be made directly to the driver.

8. Ratings and Reviews

Users may rate and review drivers after completing a trip. Reviews must be:

  • Honest and based on actual experiences
  • Free from profanity, harassment, or discriminatory language
  • Relevant to the service provided

We reserve the right to remove reviews that violate these guidelines or our community standards.

9. Lost and Found

TrikeOps provides a platform for reporting and claiming lost items. However:

  • We are not responsible for lost, damaged, or stolen items
  • Users are responsible for verifying ownership before claiming items
  • False claims may result in account suspension
  • Items should be returned to their rightful owners promptly

10. Intellectual Property

All content on TrikeOps, including but not limited to text, graphics, logos, images, and software, is the property of TrikeOps or its content suppliers and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the platform without our express written permission.

11. Limitation of Liability

TrikeOps is a platform that connects passengers with drivers. We are not a transportation provider and do not own, operate, or control any tricycles or drivers. As such:

  • We are not responsible for the quality, safety, or legality of transportation services provided by drivers
  • We do not guarantee the availability of drivers or successful bookings
  • We are not liable for any accidents, injuries, or damages that occur during transportation
  • We are not responsible for driver conduct, vehicle condition, or service quality
  • Users use the platform and transportation services at their own risk

12. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms and Conditions
  • Fraudulent, illegal, or harmful activity
  • Repeated complaints from other users
  • Failure to maintain required licenses or permits (for drivers)
  • Any other reason we deem necessary to protect the platform and its users

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on the platform and updating the "Last updated" date.

Your continued use of TrikeOps after changes are posted constitutes your acceptance of the modified Terms.
